Beonscreen.com SMS Alerts Terms and Conditions


1. For the purpose of these terms and conditions, any "We", "Us" and "Our" means Beonscreen Limited of Cecil Road, Kingswood, Bristol, BS15 8NA. We are the promoter of the services which are comprised of text information messages ("Info Messages") provided by Us that are sent direct to Your mobile phone including various entertainment and other information messages provided from time to time (the "Service"). "You", or "Your" refers to you, the customer and user of the Service. By using the Service You are deemed to have accepted these terms and conditions.

2. In receiving the Service You have chosen to receive a Beonscreen.com new listing SMS alert. Beonscreen.com new listing SMS alerts are sent to You automatically once you have registered to receive them. Beonscreen.com new listing SMS alerts are sent to you by Beonscreen.com on a regular basis once you have registered and are available to O2, Vodafone, T-Mobile, Three and Orange network customers. The cost of each Beonscreen.com new listing SMS alert sent to You is charged at £1 per Beonscreen.com new listing SMS alert. Charges for the Service will be deducted from Your available credit time if You are a pre pay customer or appear on Your monthly statement if You are a pay monthly customer.

3. Cancelling the Service: You can cancel the Service at any time please go to:
beonscreen.com/uk/sms-alerts.asp for specific instructions.

4. You acknowledge that any message material obtained from the Service is done at Your own risk and that We are not endorsing or associating with any particular person or event that may be featured within the Service.

5. You further acknowledge that You are only entitled to use the Service for lawful purposes, for Your own personal, private use and will not use the Service in breach of our or any third parties intellectual property rights in the Service.

6. You recognise that the Service may, from time to time, be adversely affected by events outside our control. We will make all reasonable endeavours to ensure the uninterrupted and timely supply of the Service and will take all reasonable steps at our expense to correct any error, omission or mistake, but will be under no liability for any error in, or delay in, or failure in transmission of the Service.

7. Components of the Service are supplied to us by third parties and We can make no promises, express or implied as to the Service, including but not limited to, its accuracy, relevance, or quality. In addition, the Service is subject to the limitations of the enabling technology on which it is reliant and may be adversely affected by network performance and other operational factors beyond Our control, including without limitation, congestion, network coverage, dropped connections, the performance of Your wireless device and the maintenance of secure network connections. We accept no responsibility if You do not receive the Service for any of these reasons. These terms and conditions will not affect Your statutory rights. In no event shall We be liable for indirect, incidental or consequential damages including without limitation, loss of income, data or other information even if We have been advised of the possibility of such damages,

8. We will not be liable to You in any way for failures, defects or delays in the delivery of the Service which are caused by one or more of the following reasons: (a) You have provided an incorrect phone number or other incorrect information before ordering a Service; (b)Your phone does not support the Service; (c)Your message mail box is full and has no additional memory to receive the download; (d) Your phone is out of range or for some other reason can not be contacted ; (e) You accidentally erase a Service provided to You. In no event shall We be liable for indirect, incidental or consequential damages, including, without limitation, loss of income, data, or other information, even if We has been advised of the possibility of such damages. In no event shall our liability exceed the price paid for the Service.

9. If we believe that there has been a breach of these terms and conditions we reserve the right to immediately and without notice withdraw or bar the services.

10. You agree that Your personal data supplied when making an order for the Service may be used by Us to monitor the use of the Service and from time to time to evaluate if we can improve the Service for customers.

11. We reserve the right to disclose information about You to applicable regulatory or government bodies where We are required by law to disclose this information.

12. From time to time we may be required to amend these terms and conditions and reserve such right. By continuing to use the Service you will be deemed to have accepted the varied terms and conditions, which will be posted at:

We reserve the right to cancel, modify or supersede the Service if, in our sole discretion, the Service is not capable as of being conducted as specified in these terms and conditions.
